Terms of Service
These Terms govern your use of the Alethena Investment platform, operated by Equility AG, Dammstrasse 16, 6300 Zug, Switzerland, registered with the Commercial Registry of the Canton of Zug under CHE-460.255.304 ("we", "us", "the Company"). By creating an account you agree to them. If you do not agree, do not use the platform.
1. Who we are and what this agreement covers
The platform is operated by Equility AG. These Terms apply to the website, your account, and every deposit, investment contract, withdrawal and referral made through it. They incorporate our Privacy Policy, Risk Disclosure, AML/KYC Policy, Cookie Policy and Refund Policy.
2. No licence claim, no guarantee scheme
Registration in a commercial registry is a company-law formality. It is not a financial-services licence and does not mean the platform is supervised by a financial regulator. Funds you commit are not protected by any deposit-guarantee or investor-compensation scheme of the kind that applies to deposits at a licensed bank. If our regulatory status is material to your decision, ask us in writing before you deposit.
3. Eligibility
You must be at least 18 years old and legally able to enter contracts. You must not use the platform if doing so breaches the law where you live, or if you are subject to sanctions. You may hold one account only. You confirm that funds you deposit are lawfully yours and are not the proceeds of crime.
4. Your account and its security
Give accurate registration details and keep them current. You are responsible for your credentials and for activity under your account. We strongly recommend enabling two-factor authentication. Tell us immediately if you suspect unauthorised access. We will never ask for your password, your two-factor code, or a wallet seed phrase.
5. Identity verification
We may require identity verification before you transact and must complete it before your first withdrawal. We may request further information at any time, and may suspend account activity until verification is complete. See our AML/KYC Policy.
6. Deposits
Deposits are made in the assets shown on the investment packages page and credit to your available balance once confirmed. A platform minimum applies. Blockchain transfers are irreversible. Sending to a wrong address, on the wrong network, or from an account not in your name may make funds permanently unrecoverable. Verify every detail before sending.
7. Investment contracts
When you commit capital, the applicable package determines your rate and cycle length. Both are snapshotted to your contract at creation and are unaffected by later changes to published packages. Your principal is locked for the cycle and unlocks at maturity. Rates are quoted per cycle, not per year. A contracted rate is a target applied to your principal — it is not a forecast and not a promise of profit. Where a package permits it, you may compound at maturity instead of returning funds to your available balance.
8. Daily trading signals
While a contract is active we issue one signal code per trading day to your registered email address. Entering it in your dashboard completes that day's confirmation. One signal is issued per account per UTC day. A signal is valid only for its own trading day; if you do not confirm it, that day's accrual is not released and a new signal is issued the next trading day. The code is an engagement mechanism, not financial advice or an instruction to trade elsewhere.
9. Withdrawals
Withdrawal conditions — minimums, waiting periods and any referral requirement — apply per withdrawal and are published on the packages page. Your dashboard shows your status against each condition before you submit. Requests at or below the auto-approval threshold are processed automatically; larger ones are reviewed first. We may decline or delay a request where verification is incomplete, where we suspect fraud or a breach of these Terms, or where we are required to by law. Payouts go only to a destination saved on your account.
10. Fees
Fees in force are published on the packages page and shown on the confirmation screen before you complete a transaction. Blockchain network fees are set by the network, not by us. We may change fees prospectively; changes do not alter a contract already created.
11. Referrals
Commission is paid on the activity of accounts you refer, at the levels published on the packages page. Self-referral, duplicate or fabricated accounts, and any scheme to inflate commissions or satisfy withdrawal conditions artificially are prohibited and may result in suspension and forfeiture of affected balances. Do not promote the platform using guaranteed-return claims, invented performance figures, or our name in a way that implies regulatory approval — you are responsible for your own promotional statements and for complying with the law where you promote.
12. Prohibited conduct
You must not use the platform for money laundering, sanctions evasion, or any unlawful purpose; hold more than one account; provide false information or documents; attempt to interfere with, probe or overload our systems; or manipulate referrals, signals or balances. Breach may lead to suspension, closure, and reporting to authorities.
13. Suspension, closure and emergency controls
We may suspend or close an account, or pause deposits and withdrawals platform-wide, where we reasonably suspect fraud or unlawful activity, where required by law, or to protect the platform's integrity. Where a pause is operational rather than account-specific, your balances and active contracts are unaffected. You may close your account at any time; conditions attaching to funds still committed continue to apply.
14. Accuracy of records
Balances are derived from an append-only transaction ledger that cannot be edited or deleted, and are reconciled continuously against it. In any dispute, the ledger is our record of what occurred. If you believe an entry is wrong, contact us promptly with the reference; corrections are made as new, linked entries so the original record remains visible.
15. Risk
Investing through the platform places your capital at risk and you may lose some or all of it. Nothing on the platform is investment, legal, or tax advice. You are responsible for your own tax position. Read the Risk Disclosure in full before committing funds.
16. Liability
We provide the platform with reasonable care but do not warrant uninterrupted or error-free operation. To the extent permitted by law, we are not liable for indirect or consequential loss, for losses caused by your own error (including sending to a wrong address), for third-party failures such as blockchain networks or payment providers, or for market movements. Nothing here excludes liability that cannot lawfully be excluded, including for intentional wrongdoing or gross negligence.
17. Changes to these Terms
We may update these Terms. Material changes will be notified to your registered email address or shown in your dashboard. Continued use after a change takes effect means you accept it. Changes do not retroactively alter the rate or cycle of a contract already created.
18. Governing law and jurisdiction
These Terms are governed by Swiss law. The courts of Zug, Switzerland have exclusive jurisdiction, subject to any mandatory consumer-protection rules of your country of residence that give you the right to bring proceedings elsewhere.
